DECISION AND REASONS:
--Following the running of Race 5, Dakins Rent-A-Loo Mobile Pace, an information instigating a protest was filed by Licensed Junior Horseman, Mr S J Thompson, driver of LIVING ON THE EDGE placed 11th by the judge, against HIGHVIEW SOUTH (M L Price), placed 2nd by the judge, on the grounds of interference. No details of the alleged interference were set out in the information but the Committee was informed that the alleged interference took place rounding the final bend.
----Mr Thompson and Mrs Price were both present at the hearing of the information and each indicated that they represented the respective connections of the horses involved.
----Mr Thompson said that, rounding the final bend just before the straight entrance, his horse was in the 1/1 and running in slightly and had its head on the side. At that point HIGHVIEW SOUTH, in the 3-wide line, began to lean in and its rear wheel came into contact with his horse's front legs causing it to go off stride.
----Mr Thompson called drivers, Mr T S Chmiel and R T May, to give evidence on his behalf. Mr Chmiel (VIN DIESEL) said that he did not see anything. He heard a "bang" and the horse in front of him went into a gallop and came back on him. He did not see Mrs Price moving inwards. Mr May likewise heard a "bang" and assumed Mr Thompson had hit the wheel of CADDON DOLL which Mr Thompson had been following. Mrs Price confirmed that Mr Thompson's horse had struck her wheel. Mr May said that the field was racing "pretty tight" but nothing untoward, he said.
----Mr Thompson said that, after his horse galloped, Mrs Price was able to get into the position he had previously occupied.
----Mrs Price suggested to Mr Thompson that, although his horse's head was turned out, it was still coming out slightly. Mrs Price maintained that she did no more that hold her line. She said that she felt that Mr Thompson was looking to come out.
----Mr N R Escott, Chief Stipendiary Steward, was asked by the Committee to give his views on the incident. He stated that there was a conflict of evidence between Mr Thompson and Mrs Price and Messrs May and Chmiel, who were "in close proximity". The evidence was "inconclusive", Mr Escott stated.
----The Committee agreed with Mr Escott that the evidence which it had heard and seen was conflicting and inconclusive. It is noteworthy that the video evidence was of little or no assistance. As a result, the Committee could not be satisfied that HIGHVIEW SOUTH was responsible for the breaking of LIVING ON THE EDGE, as alleged by Mr Thompson. Mr Thompson had failed to discharge the burden of proof in this regard and, accordingly, the protest was dismissed.
