Following the running of Race 11, The Cables Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, alleging a breach of Rule 864 (2) (d) against Licensed Public Trainers, Messrs G T & P T Court, in that “the ear plugs on YUL BRUNNER [trained by them] were applied in a manner so as that [sic] they could not be activated”.

Following the running of Race 11, The Cables Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, alleging a breach of Rule 864 (2) (d) against Licensed Public Trainers, Messrs G T & P T Court, in that “the ear plugs on YUL BRUNNER [trained by them] were applied in a manner so as that [sic] they could not be activated”.
--Rule 864 provides as follows:
(2) Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:-
(d) all gear is correctly applied and/or affixed so as not to malfunction or come adrift.
Mr P T Court, on behalf of the training partnership, had signed the Statement by the Defendant on the information form indicating that the breach was admitted and, further, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.
--Mr N M Ydgren, Stipendiary Steward, on behalf of Mr Escott, informed the Committee that it was noted that, when the horse returned to the birdcage after the Race, the ear plugs were still in place in the horse’s ears. Mr P T Court, who had driven the horse, was asked to activate the ear plugs which he duly did. His explanation was that they had become entangled in the horse’s mane in the run home and he was unable to pull them.
Messrs G T & P T Court were fined the sum of $50.
