Following the running of Race 7, Tinted Cloud/Island Glow/Holdonmyheart Mobile Place, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Horseman, Mr A D Hastie, alleging that Mr Hastie, as the driver of DREAMY POCKET in the Race, started from the incorrect barrier position.

DECISION AND REASONS:

Following the running of Race 7, Tinted Cloud/Island Glow/Holdonmyheart Mobile Place, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Horseman, Mr A D Hastie, alleging that Mr Hastie, as the driver of DREAMY POCKET in the Race, started from the incorrect barrier position.

Mr Hastie admitted the breach.

Mrs Williams informed the Committee that Mr Hastie had not been charged with a breach of the Rule previously and the breach was the result of a "basic error" on Mr Hastie's part. She said that it was fortunate that the horse had not run a place otherwise there could have been serious consequences and a possible disqualification. Mrs Williams said that another driver was also to be charged.

The start of the race, a mobile start event, was shown on video replay. Mrs Williams informed the Committee that DREAMY POCKET had drawn 5 on the second line but started from 6 outside GANDHI?S DREAM. Mr Hastie should have been aware which horse he was to follow in the run-up, Mrs Williams said.

Mr Hastie, in explanation, said that his horse had played up at the start and, when the field moved away, he assumed that he was in the correct position.

On the basis of Mr Hastie's admission of the breach, the charge was found proved and Mr Hastie was fined the sum of $200.
