DECISION AND REASONS:
--Following the running of Race 5, PGG Wrightson Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre against Licensed Junior Driver, Mr S P Walkinshaw, alleging that Mr Walkinshaw, as the driver of MR MOLLY in the Race, "drove carelessly allowing the said runner to contact the sulky of HAWTHORNE (A D Edmonds) resulting in MR MOLLY breaking".
----Mr Walkinshaw had indicated in the Statement of Defendant on the information form, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved.
----Mr McIntyre showed a video replay of the final stages of the Race. He pointed out MR MOLLY racing back in the field and unable to obtain clear racing room. He then shifted ground out wide and found room. Mr Walkinshaw continued to drive the horse until it was too late and he ran into the back of the sulky of HAWTHORNE. As a result, MR MOLLY broke. HAWTHORNE began to race erratically and caused a check to another horse wider on the track.
----Mr McIntyre recommended a fine of $200. Mr Walkinshaw was fined the sum of $200.00
