Facts:
Following the running of Race 9, the Wakefield & Williams Grass Track Final Mobile Pace, Stipendiary Steward, Mr N McIntyre lodged an Information alleging Mr T Bagrie (HIGHVIEW JIMMY) used his whip excessively during the final straight.
On being served with the Information Mr Bagrie admitted the charge and did not appear at the hearing. However, Mr McIntyre stated that Mr Bagrie had been assisted at the preliminary hearing conducted by the Stewards, by Senior Horseman Mr J R Dunn.
With the assistance of the video replay Mr McIntyre pointed out the relevant position of HIGHVEIW JIMMY at the top of the straight. He said that from approximately the 250m mark Mr Bagrie used his whip in excess of 28 times to the finish line. The Stewards deemed this to be excessive and a breach of the Rule.
Submissions for Penalty:
Mr McIntyre stated Mr Bagrie was in his third season as a horseman and had not been charged by the Stewards for any breach of the Rule in that time. The previous season he had driven 29 times. He sought a fine of $200.
Reasons for Penalty:
Mr Bagrie is given credit for his early admission of the breach and his excellent record. The committee also took into account that Mr Bagrie is a Junior Horseman.
