Facts:
Following the running of Race 7, the Avon City Ford Motukarara Xmas Cup Handicap Pace, Stipendiary Steward, Mr N McIntyre lodged an Information alleging Mr L O’Reilly (JERRY GARCIA) used his whip excessively during the final straight.
On being served with the Information Mr O’Reilly admitted the charge and did not appear at the hearing.
With the assistance of the video replay Mr McIntyre pointed out the relevant position of JERRY GARCIA at the top of the straight. He said that from approximately the 300m mark Mr O’Reilly used his whip in excess of 25 times to the finish line. The Stewards deemed this to be excessive and a breach of the Rule.
Submissions for Penalty:
Mr McIntyre stated Mr O’Reilly had previously been charged with a similar offence in February this year. On that occasion he had admitted the charge and been fined $250. He stated that since then Mr O’Reilly had driven approximately 270 times with no further breach of any rule. He sought a fine of $250.
Reasons for Penalty:
The committee took into account Mr O’Reilly’s guilty plea and also that his excellent record since his last breach of the Rule and he was accorded credit for that.
