DECISION AND REASONS:
Following the running of Race 2, Flair Fillies & Mares Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Horseman, Mr K K Chapman, alleging a breach of Rule 869 (2) (a) in that Mr Chapman, as the driver of MUSIC BOX DANCER in the Race, “used his whip excessively throughout the run home”.

DECISION AND REASONS:
Following the running of Race 2, Flair Fillies & Mares Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Horseman, Mr K K Chapman, alleging a breach of Rule 869 (2) (a) in that Mr Chapman, as the driver of MUSIC BOX DANCER in the Race, “used his whip excessively throughout the run home”.

Mr Chapman had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.

Rule 869 provides as follows:
(2)   No horseman shall during any race:-
      (a)  use his whip in an unnecessary, excessive or improper manner.

--

Mr Ydgren said that it was alleged that Mr Chapman had used his whip approximately 28 times in the final 200 metres of the Race. Mr Chapman had no explanation to offer the Stewards. He indicated that he was aware of the guidelines. Mr Ydgren showed a video replay of the final 200-300 metres of the Race.  The Committee noted that MUSIC BOX DANCER finished in 2nd placing in the Race, a neck from the winner.

Mr Ydgren recommended a fine of $200
 
Mr Chapman was fined the sum of $200.
