Following the running of Race 5, Independent Fisheries Summer Six Pack, an information instigating a protest was filed by Stipendiary Steward, Mr N M Ydgren, by BLOWHARD (A L T Lowe), placed 13th by the judge, against RIGHTEOUS FRANCO (R W Todd), placed 6th by the judge, on the grounds of interference “rounding the final bend”.
DECISION AND REASONS:
--Following the running of Race 5, Independent Fisheries Summer Six Pack, an information instigating a protest was filed by Stipendiary Steward, Mr N M Ydgren, by BLOWHARD (A L T Lowe), placed 13th by the judge, against RIGHTEOUS FRANCO (R W Todd), placed 6th by the judge, on the grounds of interference “rounding the final bend”.

Mr Todd indicated that he represented the connections of RIGHTEOUS FRANCO at the protest hearing. Mr Todd is a Junior Driver and was assisted at the hearing by Licensed Open Horseman, Mr C J De Filippi.

The Committee noted that no stake was payable for 6th placing in the Race but the protest was relevant to the result of the Six Pack, which is a form of betting, on the Race.

Mr Ydgren stated that the protest had been brought as a result of Mr Lowe’s reporting to the Stipendiary Stewards, on returning to the birdcage, that he had received interference from Mr Todd rounding the final bend.

Mr Ydgren showed a video replay of the relevant part of the Race. He pointed out BLOWHARD racing in the 1/1 with Mr Todd two back in the 3-wide line following MIDNIGHT IN PARIS (M P Jones). Mr Jones then crossed Mr Lowe. Mr Todd followed outside Mr Lowe and BLOWHARD galloped.

Mr Lowe said that when Mr Todd’s horse went past him it “hung in a bit” and made contact, cart against cart, resulting in his horse breaking. Mr Lowe showed Mr Todd’s horse with its head round and, he alleged, hanging in.

Mr Todd acknowledged that his horse did have its head round but he still had control of it, he said. He may have brushed a wheel when passing Mr Lowe but did not touch a leg, he said. Mr Todd submitted that the video showed that he was “halfway past his back legs” when BLOWHARD galloped. He was maintaining his line.

When questioned by Mr De Filippi, Mr Lowe acknowledged that it had not had been a bad piece if interference but there had been a “bump”. Mr Lowe stated that he was concerned that his horse may incur a penalty if it was found that it had galloped free of interference.

The Committee was not satisfied, based on the evidence, that RIGHTEOUS FRANCO had interfered with the progress or chance of BLOWHARD. It was unfortunate that the video evidence was inconclusive on this occasion. Likewise, Mr Lowe’s evidence was not convincing. The Committee was left in sufficient doubt as to whether interference had occurred to the extent that it did not believe that a case for relegation of RIGHTEOUS FRANCO had been made out.

Accordingly, the protest was dismissed and the judge’s placings for the Race stand.
