Following the running of Race 3, The Joshua & Lachlan Beere Trot, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Open Horseman, Mr J C Sheenan, alleging a breach of Rule 869 (2) (a) in that Mr Sheenan “used his whip excessively in the run home whilst driving CHEW THE FAT”.
DECISION AND REASONS:
--Following the running of Race 3, The Joshua & Lachlan Beere Trot, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Open Horseman, Mr J C Sheenan, alleging a breach of Rule 869 (2) (a) in that Mr Sheenan “used his whip excessively in the run home whilst driving CHEW THE FAT”.

Mr Sheenan had signed the “Statement by the Defendant” on the information form indicating, firstly, that he admitted the breach of the Rule and, secondly, that he did not wish to be present at the hearing of the information. The charge was found to be proved accordingly.

Rule 869 (2) provides as follows:
--(2) No horseman shall during any race:-
--(a) use his whip in an unnecessary, excessive or improper manner.
----
Mr Ydgren showed video replays of the final 300-400 metres of the Race. He pointed out Mr Sheenan, driving CHEW THE FAT, on the extreme outside use the whip on 20 occasions in the run home. Mr Sheenan had not disputed the number of times that the whip was allegedly used, Mr Ydgren said. Because Mr Sheenan had been driving down the extreme outside of the track, his actions were visible to everyone. There was no respite shown – it was a continuous use of the whip. Mr Ydgren suggested that the length of the straight had “tripped up” Mr Sheenan and he had, perhaps, started using the whip too early.
--Mr Ydgren told the Committee that Mr Sheenan had not previously breached the Rule within the past 12 months. Mr Ydgren recommended a fine of $200.

The Committee took into account Mr Sheenan’s admission of the breach and his good recent record. Mr Sheenan was fined the sum of $200.
