DECISION AND REASONS:
--Following the running of Race 10, Caltex Parkhouse Pace, an information instigating a protest was filed by Stipendiary Steward , Mr N M Ydgren, against GUY LYNN (R T May) placed 3rd by the judge, on the grounds of interference to FLAUNT IT (D J Dunn), placed 6th by the judge, with approximately 50 metres to run.
----Mr P G O’Reilly, trainer of GUY LYNN, was present at the hearing of the information representing the connections of the horse. Mr May and Mr M P Jones, driver of WAR GEORGE, were also present.
----Mr D J Dunn, driver of FLAUNT IT, stated that with approximately 50 metres to race he was in "a big enough gap" when the gap closed up and his horse was checked and broke. There was "a full and clear run", he said. GUY LYNN had caused the problem by ducking out.
----Mr B Williams, Stipendiary Steward, showed video replays of the final stages of the Race. Mr May had been sitting parked and had improved to the lead. There were a number of runners coming on the outside. He pointed out Mr Dunn "in space". At that point, Mr May shifted down slightly leaving clear room between his horse and WAR GEORGE for Mr Dunn. Mr Dunn’s horse ran out of room and broke when running a close 4th and still running on in a tight finish when

GUY LYNN shifted out and appeared to force FLAUNT IT onto the sulky wheel of WAR GEORGE. The latter horse appeared to maintain a straight course and did not contribute to Mr Dunn’s running out of room.
----Mr O’Reilly stated that GUY LYNN had been in the parked out position in the Race and had run in short of the finishing line. When it moved out again, it was in the same position it had been in all the way. Most of the movement had come from the outside, he submitted. He further submitted that the interference made no difference to the final placing of FLAUNT IT.
----Mr May stated that GUY LYNN had maintained a straight course for the entire straight and that WAR GEORGE had run in. Further, it was debatable if there was ever a run for Mr Dunn for more than "a stride". Any movement from GUY LYNN was "minimal", Mr May submitted. His horse had ducked out when MAGICAL MERLIN struck its wheel.
----Mr Dunn confirmed that he was running 4th when he received the check which was about 50 metres from the finishing line. Mr Ydgren submitted that it was clear from the video that Mr Dunn’s chances of running 4th were extinguished.
----The Committee was satisfied that there was interference to FLAUNT IT caused by the outward movement of GUY LYNN, placed 3rd ,when the latter horse shifted ground outwards approximately 50 metres from the finishing line, thereby denying FLAUNT IT access to the gap and the rightful line of running that it had established. The Committee was further satisfied that the interference, which caused it to break, affected the chances or progress of FLAUNT IT. The Committee did not believe that WAR GEORGE contributed in any way to the interference. On that basis and on the basis that, in the Committee’s view, the interference which took place close to the finishing line clearly cost FLAUNT IT a higher final placing in the Race, the Committee upheld the protest and relegated GUY LYNN to 6th placing
----Consequent upon the relegation, the amended placings for the Race are as follows:
