DECISION AND REASONS:
--Information No. 67829 alleged that Licensed Trainer, Mr T J Grant, had breached the Notification of Drivers Regulation in that he had “failed to notify a valid driver for his horse STARWOOD IN ASPEN”, an acceptor for Race 4, Tweedy Contracting/Ross Thomas Mobile Pace.

Mr Grant had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Paragraph 1 of the Notification of Drivers Regulation provides:
--It shall be a condition of acceptance for starting in every race at any club’s race meeting, and expressly provided in the programme of such meeting, that every person who enters a horse for a race shall, not later than [the prescribed time], notify the secretary of the club the name of the driver engaged to drive any horse in the said races. . . in any case where the driver is changed from the person who drove the horse at its preceding start.

The prescribed time for the meeting was 4.00pm on Thursday, 22 January 2009.

The Race was one for Junior Drivers and Mr Grant had failed to notify to the Club a Junior Driver for STARWOOD IN ASPEN in Race 4. Miss M R McIntyre was notified as the driver of the horse on the day of the Race.
--Mr Grant was fined the sum of $50.00.
