Following the running of Race 1, Coffee Cup on Halswell Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Driver, Mr S G Dickson, alleging that Mr Dickson committed a breach of Rule 869 (2) (a) in that, as the driver of HEAR ME OUT in the Race, he used his whip excessively in the run home.

DECISION AND REASONS:
--Following the running of Race 1, Coffee Cup on Halswell Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Driver, Mr S G Dickson, alleging that Mr Dickson committed a breach of Rule 869 (2) (a) in that, as the driver of HEAR ME OUT in the Race, he used his whip excessively in the run home.
----Mr Dickson was present at the hearing of the information and admitted the breach. The charge was found proved accordingly.
----Mr Ydgren had Stipendiary Steward, Mr N G McIntyre, show a video replay of the final stages of the Race. Mr McIntyre pointed out HEAR ME OUT at the rear of the field and wide at the turn into the home straight. From that point, Mr McIntyre alleged, Mr Dickson used his whip 24 times in the home straight, which was excessive. Mr McIntyre referred to the guidelines for use of the whip. The whip had been used on the horse which had run on to run 2nd in the race, but all horses had to be driven within the Rules, he said.
----Mr Dickson asked the Committee to take into account that HEAR ME OUT had been finishing very strongly and was only a head away from winning. In another five metres, the horse would have won the race, he said.
----Mr Ydgren informed the Committee that Mr Dickson had a clear record as far as excessive use

of the whip was concerned. He recommended a fine of $200.00.
----The Committee took into account the submissions of the parties, Mr Dickson's admission of the breach and his clear record.
----Mr Dickson was fined the sum of $200.00.
