Following the running of Race 8, Canterbury Draught Banks Peninsula Trotting Cup, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Horseman, Mr M R Hay, alleging that Mr Hay, as the driver of MARIE WISHES in the race, moved out for a run moving MAJOR DECISION wider on the track in breach of the pushout rule.
| -- DECISION AND REASONS: --Following the running of Race 8, Canterbury Draught Banks Peninsula Trotting Cup, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Horseman, Mr M R Hay, alleging that Mr Hay, as the driver of MARIE WISHES in the race, moved out for a run moving MAJOR DECISION wider on the track in breach of the pushout rule. ----Mr Hay admitted the breach and the charge was found proved. ----Mrs K R Williams, Stipendiary Steward, showed video replays of the relevant part of the race. She pointed out MARIE WISHES one out and one back (with approximately 1750 metres to run) and MAJOR DECISION behind it. She pointed out Mr Barron on the latter horse come out and, 2-3 strides later, Mr Hay come out in front of him as a result of which Mr Barron was forced to race 4-wide. Mrs Williams acknowledged that Mr Hay was unlucky in that Mr Barron had gone forward quickly because he knew what Mr Hay was intending. Mr Hay had been a little slow in reacting and a bit slow in coming out. Mr Barron had already gone forward. ----Mr Hay admitted that he had come out before Mr Barron but Mr Barron had pulled back and then come forward so fast. Normally, he would have been able to come out with him but Mr Barron had pulled back a neck and then "rushed forward" having anticipated that Mr Hay was thinking about coming out. Mr Barron had "out thought" him, Mr Smolenski said. He said that he had learned a lesson. ----Mrs Williams informed the Committee that Mr Hay has had previous breaches in the past 12 months and she recommended a fine of between $250 and $300. ----Given Mr Hay's very frank admission of the breach and the fact, as acknowledged by Mrs Williams, that Mr Hay had been somewhat unlucky on this occasion, the fine was fixed at the lower level of the range recommended by Mrs Williams. ----Mr Hay was fined the sum of $250. -------- JUDICIAL COMMITTEE |
