Following the running of Race 8, Canterbury Draught Banks Peninsula Trotting Cup, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Horseman, Mr D M Balle, alleging that Mr Balle, as the driver of MARTINA H in the race, breached the pushout rule

DECISION AND REASONS:

Following the running of Race 8, Canterbury Draught Banks Peninsula Trotting Cup, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Horseman, Mr D M Balle, alleging that Mr Balle, as the driver of MARTINA H in the race, breached the pushout rule when moving out with just under a lap to run when not clear of PRINCE SUNDON (J C Hay) resulting in that horse being moved wider on the track.

Mr Balle admitted the breach and the charge was found proved.

Mrs K R Williams, Stipendiary Steward, explained to the Committee that the incident came about because of the movement of the horses on the outside MAJOR DECISION (K M Barron) moving out and also MARIE WISHES (M R Hay). Mr Balle had also moved out and forced PRINCE SUNDON (J C Hay) to race wider on the track. She indicated that Mr Balle had viewed the video with Mr Hay and, after having done so, elected to plead guilty to the charge.

Mrs Williams showed a video replay of the incident and pointed out Mr Balle 4-back on the running line. Outside him were MARIE WISHES, MAJOR DECISION and PRINCE SUNDON. Mr Balle was racing on the back of the horse in front of him. She pointed out MAJOR DECISION come out and MARIE WISHES start to come out. Mr Balle then came off the fence resulting in PRINCE SUNDON being forced to race 3-wide and TOOMUCH TO DO (B N Orange) 4-wide. Had Mr J C Hay attempted to remain on the back of MAJOR DECISION, he would have himself been in breach of the pushout rule.

Mr Balle said that, at no stage, did Mr Hay call out for room and there was no contact between the two horses. Mr Hay had told him that PRINCE SUNDON had been pulling and this had contributed to Mr Hay's not being able to get onto the back of MARTINA H. Mr Balle said that he was happy to accept Mr Hay's version of events.

Mrs Williams recommended a fine of $200 having regard to Mr Balle's admission of the breach. Mr Balle said he was happy to accept that fine if it was the usual fine for a guilty plea to a breach of the Rule.

Mr Balle was fined the sum of $200.
