Evidence:

Mr Williams alleged that Mr Cameron, the driver of GENELIS in race 2 at the Banks Peninsula meeting on 15 March used his whip on more occasions than is permitted by cl (b) of the Use of the Whip regulations.

Mr Williams demonstrated on the race films that the respondent used his whip 11 times in the final 400 metres.

Mr Cameron admitted the charge and was not present. Mr Williams said Mr Cameron agreed the count was 11.

The Committee has viewed the video and confirms that the number is 11.

Decision:

As Mr Cameron has admitted the breach, the breach is found to be proved.

Submissions for Penalty:

Mr Williams produced Mr Cameron’s record. Mr Cameron had a previous breach of this rule on 1 November last.

Reasons for Penalty:

The breach is low-range. The Penalty Guide provides a penalty of 3 days’ suspension where it is a second breach.

Penalty:

Mr Cameron is suspended from driving from the end of racing 22 March up to and including 2 April 2020. This is 3 days.
