Following the running of Race 5, Couplands Bakery Pace, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, by LIVELY MATTERS (G D O’Reilly), placed 14th by the judge, against CLAUDIUS (C D Thornley), placed 4th by the judge, on the grounds of interference at the start.



Following the running of Race 5, Couplands Bakery Pace, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, by LIVELY MATTERS (G D O’Reilly), placed 14th by the judge, against CLAUDIUS (C D Thornley), placed 4th by the judge, on the grounds of interference at the start.

Mr Thornley had endorsed “I do not contest the protest” on the information form and had signed it “as agent”.

Mr N G McIntyre, Stipendiary Steward, showed a video replay of the start of the 2170 metre race. He pointed out CLAUDIUS, which had drawn barrier 3 in the standing start event, DON JUAN DE MARCOS (B Weaver), which had drawn 4 and LIVELY MATTERS (G D O’Reilly), which had drawn the outside of the second row. Mr McIntyre showed that, as the barrier was released, CLAUDIUS shifted up the track and, as a result, had “inconvenienced” DON JUAN DE MARCOS on to LIVELY MATTERS. Mr O’Reilly was dislodged from the sulky of LIVELY MATTERS, which lost all chance.

The Committee was satisfied, based on Mr Thornley’s electing not to contest the protest and from its own observations from the video relay, that this was a clear case of interference by CLAUDIUS to LIVELY MATTERS and the progress or chances of LIVELY MATTERS were clearly interfered with, in  fact its chances were completely extinguished.

The protest was upheld and CLAUDIUS was relegated to 14th placing in the Race. Consequent upon the relegation of CLAUDIUS, the amended placings for the Race are as follows:
