DECISION AND REASONS:

Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 508(2) alleging Licensed Trainer Mr P. D. J. Harris failed to declare riders, by the time prescribed, for a total of six of his horses in races 1, 4, 6 and 9. These breaches were admitted and Mr Harris confirmed this at the hearing.
--Mr Ching advised the Committee that no riders had been declared by 10-00am on Thursday 25 October 2007, which was the deadline. Notification of riders were made at 10-51am after Mr Harris was spoken to by staff from the National Racing Bureau.
--Penalty:
--In relation to penalty Mr Ching advised that the Mr Harris had been convicted of a similar offence on 27 April this year, and that Mr Harris had been warned previous to that charge being preferred against him. About two months ago the time for notification for Saturday and Sunday racing had been changed from 1-00pm on the preceding Thursday, to 10-00am that day.
--Mr Harris made submissions about how difficult it has been after the time for notification of riders had been changed from 1-00pm to 10-00am. In his case he had a large team of horses and this made it even more difficult for him. He also said that attempts were being made to have the time changed back to 1-00pm. Mr Harris accepted that he was bound by the Rule in its present form.
--Penalty: We were aware that a fine of $50-00 was usual for a first breach of this Rule. However this was not a first offence and there were six charges contained in the one information.
--Taking all the above matters into account we were satisfied that a fine of
--$50-00 for each breach was appropriate in this case and Mr Harris was fined the sum of $300-00.
