Decision:
Following the running of Race 3, the BDO Spicers Chartered Accountants Maiden, Stipendiary Steward Mr S. C. Ching filed an information pursuant to Rule 530(2)(b) alleging Apprentice Jockey Meo Ahmad, the rider of “Thames Street” (3), used the whip excessively prior to the 200 metre mark.
Following the running of Race 3, the BDO Spicers Chartered Accountants Maiden, Stipendiary Steward Mr S. C. Ching filed an information pursuant to Rule 530(2)(b) alleging Apprentice Jockey Meo Ahmad, the rider of “Thames Street” (3), used the whip excessively prior to the 200 metre mark.
Mr Meo Ahmad was assisted at the hearing by his employer Mr P. D. J. Harris. Mr Meo Ahmad and Mr Harris advised that this breach of the Rules was admitted, and they confirmed that they understood the Rule and the charge.
Stipendiary Steward Mr Davidson used video coverage of the incident to show that Mr Meo Ahmad had used the whip on 12 – 14 occasions without a break prior to the 200 metre mark. This evidence was not disputed. Mr Harris said that he had instructed Mr Meo Ahmad to ride the horse hard from the top of the straight, but within the whip guidelines.
--Penalty:
--In relation to penalty Mr Ching advised that Mr Meo Ahmad had been spoken to about his use of the whip at a trial meeting on 4 September 2009, but that he had no previous relevant convictions. Mr Ching recommended a fine of between
$200-00 and $300-00, but also raised the alternative of a suspension if he was unable to pay a fine.
Mr Harris advised that a fine was preferable as Mr Meo Ahmad was about to travel south for some race meetings.
--We adjourned to consider the matter of penalty. We took into account the guilty plea and the clear record. We were also satisfied that Mr Meo Ahmad would learn from this experience. On resuming the hearing we advised that Mr Meo Ahmad would be fined the sum of $200-00.
