Decision:

Mr Oatham alleged that Mr Harris was guilty of careless riding in that he allowed his mounto shift ground in near the 300 metres when not sufficiently clear of TIVERTON, which was checked.  Mr Harris admitted the charge, which we thus find proved. Rule 638(1)(d).

Mr Oatham had Mr Williamson, stipendiary steward, show the incident on the videos.  He demonstrated that Mr Harris on KRASH went for a run one off the rail on the outer of TIVERTON and to the inside of BACK IN BLACK when not his length and another length clear of TIVERTON.  Mr Grylls on TIVERTON was forced to check.  Mr Williamson commented that although TIVERTON was weakening on the fence, Mr Harris had elected to take a gap that was not there.  In mitigation, he said there was slight inwards movement from BACK IN BLACK but this was no more than a foot.  Mr Williamson demonstrated on the side-on video that KRASH was at best 1/2 a length clear.  The back-on view demonstrated the check to TIVERTON was quite severe.

Mr Harris said he had made an error of judgment in that he had believed TIVERTON was weakening quicker than it was, and that he had yelled out to Mr Lammas to give him room.  He said he only had a split second to make a judgment call but accepted that he had made the wrong decision in pushing through the gap.

Mr Oatham described the carelessness as at the lower end, although the degree of interference to TIVERTON was high, and asked for a suspension.  He produced Mr Harris’s record, which showed three breaches of this rule this season. He described this record as fair.

We view the breach as being towards the lower end of the range.  We accept there was initially a run for Mr Harris but the gap quickly closed and Mr Harris’s carelessness lay in his deciding to press forward when it was clear to him that the gap had closed.  He moved inwards when he was at best only 3/4 length clear of TIVERTON.  The result was that Mr Grylls was forced to take hold of his mount and check back as a consequence of the inwards movement from Mr Harris.  We view Mr Harris’s record this season to be good, when regard is had to the substantial number of rides he would have had in this time.  We also give credit for his ready admission of the breach.  We grant Mr Harris’s request that the suspension commence after Saturday’s racing.  He is suspended from the end of racing on Saturday 5 December up to and including Friday 11 December.  This 4 days.
