This information alleged a breach of Rule871 (1) (d) by Jockey L. K. Cropp for angling her mount PRETORIUS outwards when not sufficiently clear of SEVENTH HEAVEN (C Grylls) who was checked. The breach was admitted.

The parties confirmed the evidence from the preceding protest and agreed it was unnecessary to demonstrate the incident again.

Mr. Coles in dealing with the question of penalty stated that Miss Cropp had been charged on five previous occasions over the preceding year but he said the most recent had been on 25 October 2006 (3 days), 6 September 2006 (4 days) and before that 13 July 2006 (3 days). On the whole the stewards accepted Miss Cropp was a busy rider who rode extensively all over the country and her record had to be considered in light of that. While she had admitted the breach there had been a relegation and a suspension was suggested for a period of at least four days.

Miss Cropp asked the Committee to treat the matter as one at the lower end of the scale and with substantial commitments over the coming period to many owners and trainers, especially for the Waikato premiere meeting and another meeting at Christchurch she asked that a fine be imposed rather than a suspension.

After considering these submissions the Committee determined that a suspension had to be imposed and while a period of four days might otherwise have applied given her record and the relegation on the other hand she was entitled to credit for admitting the breach, that it was not a breach at the higher end of the scale, and bearing in mind that it included a premiere meeting a period of three days would be appropriate. Accordingly suspension was ordered from the conclusion of racing on 13th December 2006 until the conclusion of racing on 17th December 2006 the meetings affected being those at Christchurch, Te Rapa and Auckland.
