As Ms Collett admitted the breach we find the charge proved.
Penalty:
We grant Ms Collett's request to seek a deferment to her suspension as per Rule 1106(2).
Accordingly, we impose a suspension on Ms Collett which will commence after racing on 15 May and conclude after racing on 23 May 2013 (5 days).
The penalty did not include any South Island meetings as Ms Collett confirmed that she did not intend riding at any of them.
Charge:
Following race 3, NZ All Good Cosmopolitan Club 1200,an information was filed pursuant to Rule 638(1)(d). The Informant, Mr Williamson, alleged that passing the 400 metres Canthassleme( Ms S Collett) allowed her mount to shift out when not clear causing Jesshanimo (D Turner) to be severely checked.
Ms Collett acknowledged she understood the rule and the nature of the charge.
Rule 638(1) (d) states: a rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Facts:
Mr Robinson demonstrated the incident by using all the available films. He pointed out to the Committee that Ms Collett angled her mount out when only ¾ of a length clear of Jesshanimo. In doing so this resulted in Jesshanimo being forced abruptly onto the heels of Miss Directional and blundering. He said Ms Collett made an error of judgement when not realising Mr Turner was racing directly behind her.
Ms Collett advised the Committee that she had gone to move out and follow the favourite Senatorial into the race at the 400 metres. She conceded her mount had moved half a stride too far and she was not aware where Mr Turner was positioned. She admitted the check Mr Turner received was severe.
Submissions for Penalty:
Mr Williamson produced Ms Collett's record which showed 2 previous breaches under this rule in the last 12 months. He submitted a suspension of not less than 5 days and asked the Committee to determine the severity of the interference Mr Turner received.
Ms Collett submitted she had firm commitments at Ruakaka on the 15th of May and requested a deferment to her proposed suspension. She confirmed to the Committee that she was not riding in the South Island.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Ms Collett's admission of the breach and her good record. The aggravating fact is Mr Tuner's mount was severely checked as a result of Ms Collett's carelessness.
We independently assess the level of carelessness in the mid to high range.
After taking into account all the above factors we independently assess an appropriate penalty is a 5 day suspension.
The Committee further explained to Ms Collett that this type of carelessness would generally warrant a 6 day suspension and it was the mitigating factors on this occasion that permitted 5 days.
