REASON AND DECISION:

Ms M Wenn admitted a breach of Rule 871(1)(d) in that she permitted her mount HOLD THE FORT to shift inwards near the 700 metres when not sufficiently clear of MAGIC ANNA (C Grylls) taking that horses rightful line of running and causing a check to MAGIC ANNA.

Assistant Stipendiary Steward Mr Davidson demonstrated the incident on the video of the inward movement at the 700 metres when not sufficiently clear of MAGIC ANNA and a check occurred. No corrective measures were taken by Ms Wenn. This check was also contributed to by ANISSINA (A Calder) on the inside who was racing greenly at the time.

Mr Oatham made submissions on penalty in that Ms Wenn had a good record having last had a suspension for a similar breach 14 months ago. He stated that a suspension at the lower end of the scale was warranted.

Ms Wenn stated that she had a firm engagement in the fillies and mares race at Waikato on Saturday 15th December 2007 and could any suspension commence after that date. Mr Oatham was not opposed to this request.

The committee took these submissions into consideration including admission of the breach and Ms Wenn's good riding record, however, crossing when only three-quarters of a length clear was unacceptable. The committee accepted the request for a 7-day deferment and suspended Ms Wenn from riding from the conclusion of racing on the 15th December 2007, until the conclusion of racing on Saturday 22nd December 2007. This for Ms Wenn is effectively a 3-day suspension.
