Following Race 8 an Information was filed pursuant to rule 330 (B) (c).  The Informant, Mr Williamson, alleged that Mr C Ormsby failed to make the weight for HEART’S DELIGHT in Race 3 and ATTAQUE in Race 7.

Mr Ormsby admitted the breach.

Mr Williamson told the Committee that Mr Ormsby informed the Stewards early in the day he could not make the weight for the 2 horses in question and was 1 kg over.  He was replaced on both horses.

Mr Ormsby had little in way of an explanation other than to say he misjudged his attempts to make their carded weights.  He said he really had no excuse but would be more vigilant in future.

Mr Williamson said this was only Mr Ormsby’s second charge in the last 12 months after having considerable trouble in the previous 12 months.  He submitted a fine of at least $200 would be appropriate.

The Committee considered all evidence and submissions before imposing an appropriate penalty.  Mitigating factors include Mr Ormsby’s guilty plea and his recent good record.  However we must balance these factors against the need for 2 replacement riders to be found.  Mr Ormsby was reminded of his obligations and was told that hopefully today’s penalty would be a wakeup call.  Accordingly we fine Mr Ormsby the sum of $250.00
