Pursuant to Rule 648 (3) the Committee determined that SATRIANI be disqualified from the race.

Accordingly amended placings are:

1st – No. 6  LIMENTIS
2nd- No. 1 YOU’RE WELCOME
3rd - No. 9 JUTANUGARN

The Committee ordered dividends and stakes to be paid in accordance with this decision.

Facts:

This Request for a Ruling was filed pursuant to Rule 648(3) and arises following the running of Race 4, The Avondale Sunday Markets 1600 metres. The Informant, Senior Stipendiary Steward Mr M Williamson, alleged that the rider of the 3rd placed SATRIANI (M Hashizume) weighed in approximately 1kg underweight.

Rule 648(3) provides that:

If, on being weighed in, a Rider cannot draw the proper weight (meaning thereby the weight allotted by the Handicapper for his horse to carry and adjusted only by any re-handicap, by having been declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5 kg and if the allowance is not sufficient to enable the proper weight to be drawn then subject to sub-Rule (4) of this Rule then in addition to any other penalty which may be imposed the horse shall be disqualified for the Race.

Rule 649(3) provides that:

A Rider must not weigh-in at a weight that exceeds or is less than the proper weight as is defined in and with the allowance permitted by Rule 648(3).

Submissions for Decision:

Mr Reuelu was present at the hearing. He advised that he is the Wallace Stable Foreman, and he was responsible for correctly saddling SATRIANI. He said that the horse’s official trainer is Ms C Evans and he was filling in for her as she was out of Auckland. Mr Reuelu is also the owner of SATRIANI.

Mr Williamson advised the Committee that the Clerk of the Scales identified that following the running of the race the rider of the 3rd placed horse Mr Hashizume (SATRIANI) weighed in approximately 1 kg under his allocated handicapped weight. He said that weight discrepancy takes into account the allowance for his protective vest.

Mr Williamson advised that once the issue was investigated it was immediately established that the towel had been left off when saddling. The towel in question was recovered from the saddling area.

Mr Williamson sought the disqualification of SATRIANI from 3rd place.

In explanation Mr Reuelu accepted that the towel had been mistakenly omitted. He said that the stable had brought 3 towels to the races, all the same type and colour and somehow there had been a mix-up between the towels to be used for racing and the one to be used for wiping the horses down. He said that the towel omitted had been used for wiping down the horses and it was wet and therefore heavier than usual. Mr Reuelu showed genuine remorse.

Reasons for Decision:

After considering the submissions the Committee was satisfied that Mr Hashizume weighed in at least 1 kg light. Accordingly, SATRIANI must be disqualified from 3rd place.
