DECISION & REASONS:
--This information alleged a breach of Rule 302 By Licensed Trainer T. Croon for failing to comply with a directive of the Stipendiary Stewards at the Racing Tauranga meeting on 29 November 2006. The breach was admitted and the matter was adjourned for hearing at Avondale on 6 December 2006. At the hearing Miss Croon was represented by Mr. T Green.
----Mr. Oatham informed the Committee that FLYNN?S FLIGHT was shown in the programme as running in blinkers and while checking horses as they were being presented for plate inspection Stipendiary Steward A. Coles and Assistant Stipendiary Steward W. Robinson noticed, as Miss Croon was leading her horse to the plate inspector, its blinkers were missing and drew this to her attention. Miss Croon had rectified the problem and was then informed that she was required to report to the Stewards but had failed to do so. The Stewards made several attempts to have her attend but subsequently discovered she had left the course.
----Mr. Green confirmed that Miss Croon acknowledged her mistake and accepted responsibility for her action. She had been alone with her horses and had put herself under pressure but was aware of her obligations and that was why she admitted the breach in this instance although she had defended the earlier matter.
----Mr. Oatham said it was a serious matter. Three instructions had been issued and had not been acted on. He accepted she had not previously been in breach of this Rule, had promptly admitted her error and a fine of approximately $500 was suggested to address the seriousness and send an appropriate message to License Holders.
----Mr Green said Miss Croon accepted what Mr Oatham had said and left it to the Committee to assess the fine.
--------After considering submissions on penalty the Committee is satisfied that Miss Croon is entitled to credit for her admission, good record and responsible attitude at this time. She was reminded that as a License Holder she had certain responsibilities to those with whom she dealt during her racing activities and should seek to avoid a situation such as this from recurring. Taking all these things into account the Committee determined that a fine of $400 should be imposed and ordered accordingly.
