This information alleged a breach of Rule 850 (1) (4) by Jockey O.P.Bosson for riding in a Body Protector that had not been approved by the Board of NZTR. The breach was admitted.

Mr. Coles informed the Committee that Stipendiary Steward C. George had seen Mr. Bosson in the jockeys' room prior to Race 3 and informed him that the Body Protector he was seen wearing was not approved by the Board of NZTR for use in New Zealand and therefore could not be worn during racing. Following Race 3 it was established that he had nevertheless worn the unapproved Body Protector for that race.

Mr. Bosson explained that he had borrowed an approved Body Protector for his ride in the first race but had been unable to use it later and could not find another in time for the third race.

Mr. Coles said it was a serious matter and noted that another offence for this had recently incurred a fine of $1,500. He suggested that a fine of this amount needed to be imposed in this matter also to reflect that seriousness.

After considering these submissions on penalty the Committee is satisfied that a serious issue of safety is involved and riders need to be aware of this. In Mr. Bosson's case it was unfortunate that he failed to recognise this and even at the late stage he found himself without an approved Body Protector should have brought the matter to the attention of the Stewards. Accordingly a fine of $1,500 was imposed.
