Information 0669 alleged a breach of Rule 871(1)(d) for careless riding by Apprentice Jockey B Lammas (HABANA) in that he angled outwards early in the final straight when not sufficiently clear of IMANANABAA (C Lammas) then continued to shift outwards when ridden with the whip making further contact with IMANANABAA.

The breach was admitted and as an apprentice Mr Lammas was represented by his employer Mr Gibbs.

Mr McCutcheon indicated that the parties relied on the evidence provided at the earlier protest hearing and he proposed dealing only with penalty submissions. In that respect he informed the committee that this was the first occasion Mr Lammas had been charged with a breach of this rule after having over 700 rides to his credit. Because of this the stipendiary stewards felt that although this was a premier meeting and followed relegation in a listed race, which normally would call for a heavier penalty, a suspension period of three days was suggested.

Mr Lammas asked the committee to also have regard to contributing factors mentioned at the earlier protest hearing and in particular the pressure he was under from the winner's outward movement.

Mr Gibbs asked the committee to take into account that Buddy Lammas' riding record was outstanding for someone with just over twelve months experience and had been recognised by the industry in selecting him to go to Dubai recently where he had raced with success. He had made an error today, he knew it and would learn from it. Maybe there was an element of rivalry given it was his brother on the stable horse that had been racing outside him but he would have learnt from this. The effect of a suspension involving the loss of a Cup engagement would also be significant.

The committee accepts the recommendations regarding penalty and has taken into account what has been said. It therefore orders that suspension be imposed from the conclusion of racing on Sunday next 4 December 2005 until the conclusion of racing on Saturday 10 December 2005 involving three days of racing namely Wednesday at Auckland, Thursday at Hawera and Saturday at Waikato.
