DECISION & REASONS:
--This is a protest under Rule 876 (1) of the Rules of Racing by Chief Stipendiary Steward N McCutcheon following Race 7 alleging that HABANA (B Lammas) or its rider placed second by the judge interfered with the chances of IMANANABAA (C Lammas) placed fourth. The interference was alleged in the final straight and the margin between third and fourth was a head. Mr. McCutcheon reserved the right to charge. He confirmed that all connections were present or represented.
----Stipendiary Steward J Oatham demonstrated the incident on video. He pointed out an outward movement by HABANA first at the top of the straight and then a further three occasions. Each time it was insufficiently clear and forced IMANANABAA out over extra ground while being ridden out with the whip.
----Cameron Lammas confirmed that he had suffered interference and believed it had cost him a chance of a better placing. Mr Gibbs, the trainer of IMANANABAA, asked the committee to note that the interference had continued more than once down the straight and had clearly cost his horse more than the official margin of a head.
----Buddy Lammas agreed that his mount had come out despite his attempts to correct. He felt the other horse had over reacted and while he had angled out and pulled back on each occasion Cameron Lammas had also rolled in.
----Mr Hillis, the trainer of HABANA, conceded that while his horse had initially bumped the other it was as the field generally went wider into the straight and to some extent the winner had dictated to his horse, which as a first starter also raced greenly.
----Summing up Mr McCutcheon indicated that there was clearly interference by the second horse HABANA that forced out the fourth horse IMANANABAA over extra ground and it had occurred on three or four occasions. He submitted that there was no doubt that it cost IMANANABAA third placing and the protest should therefore be upheld.
--After considering the above the Committee is satisfied the evidence establishes that interference has occurred as alleged. That interference has been caused by HABANA and it has affected the chances of IMANANABAA. Despite the suggestion of some contributing factors by Mr Hillis the committee is not satisfied that this is correct and it accepts that HABANA and its rider must accept responsibility for costing IMANANABAA the chance of third placing. Because the margin between third and fourth was a head the committee is satisfied that it should exercise its discretion to relegate and the protest is upheld. The placings will now be as follows
