DECISION AND REASON
--In Race 8, the ?Fruit World 1600, Stipendiary Steward Mr A Coles, filed an information alleging a breach of Rule 871(1)(d) by G Cooksley, rider of PROMETHEAN, in that he angled out for a run near the 200 metres causing a check to TIGHT GENES ridden by A Calder.
--Mr Cooksley admitted the breach of the rule.
--In submissions as to penalty the committee viewed the video and Mr Oatham described how G Cooksley was only three-quarters of a length clear of A Calder as he took his line and checked A Calder on TIGHT GENES.
--Mr Coles submitted that it was on the lower scale of careless and stated that Mr Cooksley's riding record was excellent for the number of rides over the last year with only one breach of the rule.
--Mr Cooksley asked for consideration of a fine.
--The committee considered the riding record and admission of the breach of the rule as well as the lower scale of careless when imposing a suspension from the conclusion of racing on 30 January 2006 until the conclusion of racing on 8 February 2006, effectively 3 days.
