Accordingly, the Committee declared PASHA SUMORE to be a non – starter.

Facts:

Following the running of Race 9, Sandy Lane Tender 1400, an Information was filed pursuant to Rule 632. The Informant, Mr M Williamson, Requested a Ruling from the Judicial Committee as to whether PASHA SUMORE was denied a fair start due to mechanical failure of the gates.

Rule 632 provides “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placing’s was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”

All parties present acknowledged that they understood the nature of the Information and the Rule which was read aloud by Mr Williamson.

Submissions for Decision:

Mr Williamson demonstrated to the Committee on the head - on video film that PASHA SUMORE’S gate failed to open in conjunction with all the other starting stalls. He identified on the head - on film that PASHA SUMORE left the stalls awkwardly and believed the incident cost the horse about one length. Mr Williamson submitted PASHA SUMORE was denied a fair start due to a mechanical failure of the starting stalls and was of the view the horse should be declared a non – starter.

Mrs Leifting submitted PASHA SUMORE was denied a fair start with her gate slow to open. She added this resulted in PASHA SUMORE beginning awkwardly.

Miss Jones submitted her gate was slow to open and this resulted in PASHA SUMORE jumping awkwardly. Miss Jones added she had to dodge the gate.

Mr Harrison submitted the gate was definitely slower than the others to open which denied PASHA SUMORE a fair start.

Reasons for Decision:

The Committee carefully considered the submissions presented and reviewed the video films. It was very clear PASHA’S SUMORE starting stall was slow to open due to a mechanical failure. I am satisfied this materially prejudiced the chances of PASHA SUMORE because she lost about 1 length at the start after beginning awkwardly. This resulted in PASHA SUMORE being forced to race 3 wide with no cover for the first 400 metres of the race.
