Ms Farr’s Licence to ride in races was suspended from the end of racing on 30 July 2016 through to the end of racing on 4 August 2016 (2 days).
Ms Farr was advised by the committee of the possible consequences should she reoffend within a short period of time.
Facts:
Following the running of Race 4 (The Waterview 1400), Information No. A7600 was filed with the Judicial Committee. It was alleged that Ms Farr used her whip excessively on CAMBERS prior to the 200m.
Rule 638(3)(b)(ii) provides:
A rider shall not strike a horse with a whip in a manner or to an extent which is excessive.
Ms Farr said that she understood the Rule, the charge and confirmed that she admitted the breach.
Mr Coles showed the film replays and said that Ms Farr had hit her horse 11 times between the 400 and the 200m. He added that she did give the odd break in between the strikes but that it was not sufficient.
Ms Farr, for her part, said that she clearly understood the Rule and the whip guidelines, but that on this occasion her whip use was due to a lack of concentration. She said that she did put the stick away but that it was not enough. She said that she did not hit the horse hard and realised that she needs to push more.
Mr Harris said that he has been assisting Ms Farr with her riding and that she is getting better with using the whip than when she was primarily a jumps jockey. He said he teaches all apprentice jockeys that less whip use is best.
Submissions for Penalty:
Mr Williamson advised the committee that on 24 July 2016 Ms Farr had breached the whip rule and was fined $250. He said that he was aware that the JCA penalty guidelines provided for a suspension if a rider reoffended within 6 months.
Ms Farr said that she was told the last time (24 July) by the committee that if she breached the rule again within 6 months that a suspension may be imposed. She said that if a suspension was to be imposed that she would like it to commence after racing on 30 July 2016.
Reasons for Penalty:
The only mitigating factor was that Ms Farr had admitted the breach. An aggravating factor was that Ms Farr reoffended within a week of being fined for a similar breach. Having regard to the JCA penalty guidelines the committee determined that a suspension of Ms Farr’s Apprentice Jockey’s Licence was the appropriate penalty.
