The following horses are declared as non-starters in the race:-

Red Raven (1) - R Elliot

Master of Speed (3) - M Coleman

Shine On (9) - M Cameron

Jumeriah (12) - M Du Plessis

Arctic Miss ( 18) - T Thornton

Authorisation is given to the payment of amended dividends as a result of the five horses being declared non-starters.

Facts:

Following the running of Race l the "Magness The Mighty Steam Train 2100" Information A8856 was filed by Stipendiary Steward Mr Coles seeking a request for a ruling under Rule 632. The Information requested "whether or not any horse was denied a fair opportunity due to the siren (false start) being sounded soon after the start was effected".

Rule 632 states "If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter".

Prior to the hearing commencing all the riders in Race 1 were called to the Judicial Room. The Starter Mr Sargent explained that immediately after the race started as he was moving the stand that he stood on when starting the race he accidently engaged the false start siren.

Submissions for Decision:

Mr Coles asked the riders who had heard the siren to identify themselves and 5 of the 16 did so - Messrs Du Plessis (drawn 7), Coleman (drawn l ), Cameron (drawn 8), Elliot (drawn 15) and Ms Thornton (drawn 3). These were identified on the film of the start by Stipendiary Steward Mr Jones.

Mr Du Plessis said just as he jumped he heard the siren and grabbed hold of his horse and started to ease up thinking it was false start. By the time he got to the winning post he realised it wasn't but by then was "in a hopeless position".

Mr Coleman said he had gone about 50m when he heard the siren. He said he called out "false start" to Ms Thornton on his outside and looked around to check the gates. He said he then started to ease his horse out of the race. He said as Mr Du Plessis came up beside him Mr Du Plessis said to him they were carrying on but by then was at the rear instead of mid field as he had planned to be. He also pointed out to the Committee that he was on the favourite and said that on returning to the birdcage he immediately told the trainer of his horse he thought a false start had occurred.

Mr Elliot said he came across and was close to Mr Cameron (who said he had heard the siren) soon after the start and called out to him thinking there was a false start but when they both realised it wasn't they carried on at the rear of the field.

Ms Thornton said she heard the siren sound and looked around two or three times to see what had happened and started to ease up losing about 15 lengths before she realised the race was continuing.

Senior Stipendiary Steward Mr Williamson said that given the number of horses who were affected by the siren sounding the question of whether the race should be declared null and void also needed to be considered.

Reasons for Decision:

The Committee has considered the film of the start and the submissions of Starter and the 5 riders affected. There is no doubt the 5 riders who heard the siren started to ease their horses out of the race to varying degrees soon after the start before then "kicking on" and taking a full part in the race. Clearly the most affected was Ms Thornton who looked behind 3 times in the first 1OOm and in doing so lost considerable ground. All of the 5 riders told the Committee their chances were significantly affected and none of them finished closer than 5th. The Committee does not believe the race should be declared null and void but to be fair to the connections of the 5 horses and the betting public who invested on them they should be declared non-starters as the sounding of the siren materially prejudiced the chances of those horses.
