After taking all the above into account we impose a fine of $150.

Facts:

Following race 5 an information was filed pursuant to rule 638 (3) (b).  Mr Williamson alleged that Mr M Walker used his whip in an excessive manner prior to the 200 metres on MAREKA MISS.

Submissions for Decision:

Mr Coles demonstrated the video films pointing out MAREKA MISS racing on the outside of the field approaching the home turn.  He showed Mr Walker striking his mount 16 to 19 times before the 200 metres without giving the required 6 stride respite.  Mr Coles submitted that Mr Walker was not bashing his mount and his action was one of backhand strikes and not high handed.

Mr Walker in admitting the breach said he was used to riding in Australia where backhand striking of the whip without respite was allowed prior to the 200 metres.  He added he had won the race.

Submissions for Penalty:

Mr Williamson said Mr Walker had a clear whip record and although he breached the guide lines he conceded his whip action was only of a backhand motion.  He submitted a fine of $150 would be appropriate.

Mr Walker had nothing to add regarding penalty.

Reasons for Penalty:

The committee considered all submissions and evidence.  Mr Walker was clearly in breach of the guidelines for not giving his mount the 6 stride respite.  However this was his first offence under this rule and he admitted the breach.  The committee independently assesses his breach at the low end.
