As the breach was admitted we find the charge proved.

Penalty:

After taking all the above into account the committee finds the appropriate penalty to be one of 5 days. Therefore Mr Wong is suspended from the conclusion of his current suspension, the 3 May, until after racing on 12 May (5 days).

Facts:

Rule 638 (1) (d) reads as follows: a rider shall not ride a horse in a manner which the judicial committee considers to be careless.

Following race 8, The Battersby Funeral Directors 1400, an information was filed pursuant to rule 638 (1) (d). The informant alleged that Mr J Wong permitted his mount FALCON REGIMENT to shift inwards when not sufficiently clear of TROUSSEAU which was checked near the 350 metres.

Mr Oatham demonstrated the video films pointing out FALCON REGIMENT racing against the rail and near the lead approaching the final turn. It was evident on the films that soon after turning for home Mr Wong allowed his mount to shift out and into the line of TROUSSEAU (Miss K Myers). This caused Miss Myers to try for a run on the inside of Mr Wong. That run was stopped by Mr Wong as he allowed his mount to move in towards the rail again when being ridden with the whip. At this stage Miss Myers was ¾ of a length behind Mr Wong but when her run was blocked she was forced to check sharply and her chances were extinguished.

Mr Scott said it was clear Mr Wong had rolled in causing a check to Miss Myers. He said FALCON REGIMENT was not the easiest horse to ride and there was nothing sinister in Mr Wong’s actions.

Mr Wong had nothing to say when asked.

Submissions for Penalty:

Mr Williamson said Mr Wong has had 193 rides in his career so has had limited experience. His record showed 2 suspensions in the last 12 months. He said in today’s incident Mr Wong had not acted quickly enough when his mount started to move in and it was his obligation to keep his mount in a straight line. Mr Williamson submitted Mr Wong’s carelessness was in the low to mid range but the interference to Miss Myers was severe. He added that Mr Wong was presently riding under a deferral and he has yet to serve a 4 day suspension which will be completed after racing on 3rd May.

Mr Scott said Mr Wong only rode in the northern half of the North Island.

Reasons for Penalty:

The committee has carefully considered all the evidence as presented. Mitigating factors are Mr Wong’s inexperience and his admission of the breach. However in this case Mr Wong continued to ride with the whip when his mount was running erratically and he made no endeavour to keep it straight. The strong aggravating fact was the severe check to Miss Myers.
