Following race 4, The FaceUp 1400, a request for a ruling was filed pursuant to rule 632. The request is to whether SACRED WINS was denied a fair start due to a mechanical failure to its barrier.
Submissions for Decision:
Mr Oatham demonstrated the video films pointing out to the committee SACRED WINS starting from gate 10. He said it was obvious the gate did not open in unison resulting in SACRED WINS being denied a fair start.
Mr Innes said his gate was slow to open but not by a lot. However he said he was 2 places further back than he anticipated.
Mr Harrison confirmed the gate was slow with SACRED WINS losing at least a length.
Reasons for Decision:
The committee carefully considered all evidence and reviewed the relevant video footage. The films clearly showed the gate was slow to open due to a mechanical failure. Accordingly we are satisfied the chances of SACRED WINS were materially affected due to him being denied a fair start.
