In Race 4 an information instigating a protest was lodged by Stipendiary Steward Mr A Coles against BAILEYS COMET, placed first, ridden by apprentice Samantha Spratt (Trainer Mr R Yuill), alleging interference in the final straight to DAN HO, ridden by Trudy Collett (Trainer Mr G Shirley), placed third.

BAILEYS COMET was represented by trainer Mr R Yuill and DAN HO by trainer Mr G Shirley. Margins at the finish were a long head between first and second and half a length between second and third.

Mr Coles stated that DAN HO, who was improving on the outside of BAILEYS COMET 100 metres from the finish, was forced over ground with contact on two occasions when BAILEYS COMET moved outwards under a vigorous ride. The outward movement was 4 ? 5 horse widths and Mrs T Thornton stated she lost 3 lengths and was unable to ride DAN HO out.

Stipendiary Steward Mr Oatham demonstrated on the head-on and side-on films the passage outwards of BAILEYS COMET and the effect of two contacts on DAN HO, who made up ground to be half a length from the second horse MOKOIA ROAD at the line. Mrs Thornton confirmed that there was contact on two occasions and that DAN HO was improving at the start of the interference. Mr Yuill admitted that interference had occurred but contended that as DAN HO had run third could not have won the race. Trainer Mr G Shirley agreed with the evidence of Mr Coles and Mrs T Thornton.

The judicial panel considered that interference occurred to DAN HO when making a forward movement and this was caused by BAILEYS COMET's outward movement, affecting the chances of a better placing for DAN HO, through checking the progress of DAN HO by making contact on two occasions and by forcing it over extra ground.

The judicial panel exercised discretion to relegate BAILEYS COMET behind DAN HO, taking into account the check of up to three lengths and that DAN HO finished on to within half a length of the second placed horse MOKOIA ROAD.
