Following the running of race 4 The O’Hanlon Family 1400m, information 41620 was filed by Stipendiary Steward Mr M Williamson in which he sought a ruling under rule 632  “ as to whether horse 11 SUMMER LEE be declared a non runner due to a starting gate malfunction”.

Rule 632 states “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-runner.”

Before the film of the start was shown, Stipendiary Steward Mr Oatham advised of the confirmed placings in the race and that SUMMER LEE did not finish in the first three placings.

Mr Williamson showed the head-on film of the start of the race.  The film showed that the gate of SUMMER LEE, which was drawn 7 in the 10 horse field, was fully closed when all the other horses in the race had left the gates.  When the gate did open and SUMMER LEE jumped out the horse was at least 15 lengths behind the second to last horse.

Decision

--

After viewing the film the Committee agrees that SUMMER LEE was denied a fair start and prevented from taking an effective part in a race owing to the mechanical failure of starting stalls which materially prejudiced the chances of the horse.  We note that SUMMER LEE finished last in the race some 11.4 lengths form the winner.  Accordingly SUMMER LEE is declared a non runner in race 4.
