This is a protest under Rule 876 (1) of the Rules of Racing by Stipendiary Steward A R Coles following Race 8

DECISION & REASONS:

--

This is a protest under Rule 876 (1) of the Rules of Racing by Stipendiary Steward A R Coles following Race 8 alleging that MACAVELLI MISS or its rider placed first by the judge interfered with the chances of SIR VALIANT placed second. The interference was alleged in the final straight and the margin between first and second was a nose. Mr. Coles reserved the right to charge.

The connections of MACAVELLI MISS were represented by Miss Jane Lowe and of SIR VALIANT by its Trainer Mr. Jon Miller.

Stipendiary Steward J Oatham demonstrated the incident on video. He pointed out an outward movement of approximately four mown strips or six to eight horse widths starting from the 200 metre mark and continuing steadily in the run to the winning post where the horses concerned finished quite wide out on the track. Mr. Coleman, the rider of SIR VALIANT, he said, had continued riding throughout and was gaining steadily but his line was dictated over this distance by MACAVELLI MISS, ridden by M. Hills, which was never sufficiently clear.

He was questioned by Miss Lowe who asked if the horses had touched. He was unable to say this but said that SIR VALIANT had clearly been hampered and forced off the line to which it was entitled. Given the margin of a nose he believed it had definitely affected its chances.

Mr. Miller stated that he believed the video was quite conclusive and his horse's chances had been affected.

Miss Lowe again queried whether the horses had actually touched and this was put to Mr. Coleman. He said that contact had occurred on three occasions and confirmed that he believed the extra ground over which he had been obliged to travel had cost him a winning chance.

After considering the above the Committee is satisfied that the outward movement has been established over the final 200 metres resulting in interference as alleged. Given the margin of a nose at the finish and the way in which SIR VALIANT had been forced over extra ground as a result there is no doubt that its chances had been affected. Accordingly the protest is upheld and the placings will now be as follows:
