Decision:

Miss Vance has admitted the breach and therefore the Committee finds the charge proved.

Penalty:

The Committee orders that Miss Vance's Riders Licence is suspended from the conclusion of racing on the 28th of March 2018 until after the conclusion of racing on the 6th of April 2018 being 6 National Riding Days.

Facts:

Following the running of the AJC MEMBERS 2100 an Information was lodged by Stipendiary Steward Mr A Coles against Class A Rider Miss M Vance alleging that Miss Vance when riding SHOCKOOL allowed her mount to shift out near the 400 metres mark when not sufficiently clear of MR NIK which was hampered and in turn shifted out hampering LUCKY DREAMER and CURIOUS GEORGE.

Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Miss Vance was present at the Hearing and she acknowledged that she understood the Rule and she confirmed her admission of the breach.

Using the available race films Mr J Oatham identified the horses involved in the incident being MR NIK (V Colgan), CURIOUS GEORGE (A Collett) and LUCKY DREAMER (C Dell). He showed where at about the 400 metres mark Miss Vance's mount was racing adjacent to the running rail. She then shifted her horse outwards to a 5 wide position and as a result Mr Colgan was required to take hold of and steady his mount. As a result CURIOUS GEORGE and LUCKY DREAMER which were racing on the outside of Mr Colgan's mount MR NIK then suffered some interference and were pushed wider on the track as the field entered the home straight.

Mr Oatham said that at the time of the incident Miss Vance's mount was not the required distance clear of MR NIK and he said it was an abrupt shift but he thought that the consequences of the shift were relatively low level. He said that Mr Colgan had told the Stewards that his mount was not racing well at the time of the interference although it did finish third in the race.

Miss Vance told the Committee that although she shifted out 5 horse widths she had a clear passage at least for the first 4 horse widths. She conceded that the issue was the shift from the 4 to 5 wide position when not clear of Mr Colgan's mount. She did say that Mr Colgan took hold of his horse for only 1 stride and she further said that Mr Dell's horse was hanging.

In response to a question from the Committee Miss Vance acknowledged that her mount had made contact with MR NIK and that that horse had been shifted sideways.

Submissions for Penalty:

Mr Coles said that Miss Vance had only had one previous breach of this Rule on the 6th of January 2018 and for that she received a 4 (National Riding days) suspension. He said that overall her record is very good and he said that the level of carelessness was low.

Miss Vance submitted that the carelessness was low level and she said that this was only her second breach of this Rule in the 2 years since she resumed race riding in NZ.

Miss Vance asked for a deferment of any suspension of her Licence until after the Matamata Racing Club's meeting on the 28th of March 2018.

Reasons for Penalty:

In considering penalty the Committee reviewed the race films several times and also reviewed the evidence and submissions presented.

We are told that the level of seriousness was low but the aggravating features are that the movement by Miss Vance was abrupt and that 3 horses were affected albeit to varying degrees. We are told that Mr Colgan indicated to the Stewards that his chances were not affected but despite the check he was still able to finish on and run third.

Our view is that the totality of the incident puts it at the very least in the low to mid range of carelessness and for that we have adopted a starting point penalty of suspension of Licence for 7 national Riding days.

We have given Miss Vance credit for her admission of the breach and her good record and have reduced the penalty by one day.

We have also pursuant to Rule 1106(2) granted Miss Vance a deferment of her suspension until after the conclusion of racing on the 28th of March 2018.
