Facts:
Following the running of race 6, Sheriff Handicap 2200, an Information was filed pursuant to Rule 638 (3)(b). The Informant, Mr Coles, alleged that Mr B Jones used his whip in an improper manner when he struck his mount ZARAZEN on the head with his whip in the starting stalls.
Mr Jones acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach.
Rule 638(3) (b) provides: A rider shall not strike a horse with a whip in a manner or to an extent which is unnecessary, excessive or improper;
In response to a question from the Committee, Mr Coles stated this was not a misconduct charge.
Mr Williamson identified on the video films that prior to the start of the race ZARAZEN became fractious in the stalls and threw its head on the ground. He described the strike as a “tap” and noted Mr Jones did not use any force. However, he conceded it was not a good look for the Trackside viewers.
Mr Jones said his mount wasn’t concentrating in the barriers and was proving difficult to settle. Mr Jones said he gave his mount a brief “tap” in an endeavour to get its mind back on the job.
In response to a question from the Committee, Mr Jones did acknowledge that his actions were not a good look for the Trackside audience.
Submissions for Penalty:
Mr Coles produced Mr Jones’ record which showed he had not breached this charge previously. He described Mr Jones strike as a “tap” and added there was no malice on his part. He advised the Committee of a similar breach of this Rule which incurred a $300 fine. Mr Coles submitted an appropriate penalty for today’s breach would be a fine of no more than $300.
Mr Jones submitted that he was aware of the $300 fine imposed previously and assessed his breach at the lower end. Mr Jones reiterated his strike was only a “tap” and confirmed there was no malice involved.

The Committee carefully considered all the evidence and submissions presented. The mitigating facts are Mr Jones’ admission of the breach and his clear record in relation to this breach. The aggravating fact is the vision of a rider striking his horse on the head is not a good image for the industry. I would describe the strike as a “flick” and accept there no malice on Mr Jones’ part.
After taking into account all the above facts the Committee considers an appropriate penalty is a $250 fine.
