As Mr Rusof admitted the breach the Committee found the charge proved.

Penalty:

Mr Rusof was fined the sum of $300.

Facts:

Prior to the running of race 6, Auckland Alarms 1600, an Information was filed pursuant to Rule 330 (3) (c). The Informant, Mr Williamson, alleged that Mr Rusof failed to make the weight for TOKYO LIL.

Mr Rusof endorsed the Information that he admitted the breach and he did not wish to be present at the hearing.

Rule 330(3)(c) provides: “A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.

Mr Williamson advised that Mr Rusof failed to make the handicapped weight of 55 kgs on TOKYO LIL.

In response to a question from the Committee, Mr Williamson advised that Mr Rusof was more than 1 kg over the handicapped weight.

Submissions for Penalty:

Mr Williamson said that today was Mr Rusof’s 3rd breach of this Rule.

12 October - $100 fine

10 November - $200 fine

Mr Williamson submitted a fine of not less than $200.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

The onus is on Mr Rusof to manage his weight so he does not let down the Owners, Trainers and the betting public who have supported him. With this being Mr Rusof’s 3rd breach an uplift from his prior penalty is necessary.

The only mitigating fact was Mr Rusof’s admission of the breach.

After taking into account all of the above factors the Committee deemed that an appropriate penalty was a $300 fine.
