As Mr Weatherley admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Mr Weatherley had his license to ride in races suspended for a period to commence after racing on 7 February and conclude after racing on 15 February 2020.

Facts:

Following the running of race 4, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Weatherley angled SATIN RUBY outwards when not sufficiently clear of SONORITY (S Spratt) which was hampered and forced wider passing the 250 metres.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Weatherley said he understood the Rule and confirmed that he admitted the breach.

Mr Harris assisted Mr Weatherley at the hearing.

Mr Coles demonstrated the incident using the available video footage. He identified that approaching the 250 metres SATIN RUBY was held up for a run. He said shortly after that point Mr Weatherley angled his mount outwards when not sufficiently clear of SONORITY. As a result that runner was hampered and forced wider on the track.

Mr Weatherley said that SATIN RUBY was travelling well and he didn’t realise that SONORITY was racing to his outside. He said the interference was an error of judgement on his part.

Mr Harris had nothing to add.

Submissions for Penalty:

Mr Williamson produced Mr Weatherley’s record which showed 2 previous breaches under this Rule in the last 12 months, the most recent being on 13 December 2019. He said Mr Weatherley was frank with the Stewards and accepted the interference was an error of judgement. He described the level of carelessness as low range and a penalty in line with that would be appropriate.

In response to a question from the Committee, Mr Williamson confirmed that Mr Weatherley incurred a suspension for excessive use of the whip in the Wellington Cup which concludes after racing on 7 February.

Mr Weatherley said that any proposed suspension could start after 7 February.

Mr Harris asked for leniency.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.

It was evident on the video films that Mr Weatherley angled his mount outwards near the 250 metres when not the required distance clear of SONORITY. As a result that runner was impeded and forced out wider on the track. The Committee deemed the level of carelessness to be low range.

The JCA Penalty Guide starting point for low range carelessness is 6 days which was adopted.

There were no aggravating factors.

The mitigating factor was Mr Weatherley’s admission of the breach. For this he was afforded a 1 day reduction in penalty.

Mr Weatherley’s careless riding record was deemed to be a neutral factor. Mr Weatherley accepted that it was an impatient ride.

After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.

The Committee noted that this suspension includes 2 Premier race meetings.
