Penalty:
We grant Ms Collett’s request to seek a deferment to her suspension as per Rule 1106(2).
Accordingly, Ms Collett had her license to ride in races suspended for a period to commence after racing on 25 February and conclude after racing on 3 March 2017 (4 days).

Facts:
Following the running of race 5, NZB Insurance Pearl Series Race, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Ms A Collett allowed her mount NIKITA to shift out passing the 600 metres when not clear of SARONIC MISS (J Nason) forcing that runner out onto APOLLO’S DAUGHTER (A Schwerin) with both those runners being hampered.
Ms Collett acknowledged that she understood the Rule and confirmed her admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Coles demonstrated the incident using all the available video footage. He identified that passing the 600 metres Ms Collett angled her mount out from behind MY DAKOTA and in doing so she crowded SARONIC MISS. He noted that Mr Nason firmly restrained SARONIC MISS and that hampered APOLLO’S DAUGHTER who was forced wider on the track. He showed that as Ms Collett attempted to take a marginal run MY DAKOTA contributed to the incident when that runner lay off the running rail slightly.
Mr Williamson also highlighted that passing the 600 metres SALT ‘N’ PEPPER was weakening and came back onto SARONIC MISS’ running line when Ms Collett angled her mount out from behind MY DAKOTA. He said this was an additional contributing factor to the incident.
Ms Collett said the Stewards had summed up the incident perfectly. She said that Mr Nason was racing 1 and ½ horse widths off the rail at the 600 metres and she took the opportunity to shift outwards. She said that MY DAKOTA certainly contributed to the crowding when that runner shifted away from the running rail. She identified on the video footage that SARONIC MISS over reacted to the incident at the 600 metres and highlighted that earlier in the race SARONIC MISS’ racing manners had been erratic.
Submissions for Penalty:
Mr Williamson produced Ms Collett’s record which showed she had 5 previous breaches of this Rule in the last 12 months. He said this was not a good record.

Mr Williamson said that Ms Collett improved her mount into a marginal run when not the required distance clear. He said the level of carelessness was in the low to mid – range and recognised that there were some contributing factors to the crowding that occurred.
Ms Collett said the level of carelessness was at the low end of the scale. She also noted that there were some contributing factors which resulted in the interference occurring.
Ms Collett advised that she had engagements up to and including 25 February and any proposed suspension could start after that date. She agreed that her record was not good.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point for careless riding is a 5 day suspension which is adjusted based on the mitigating and aggravating factors.
The mitigating factors were Ms Collett’s admission of the breach and the fact that we consider the level of carelessness was low end. We accept that the video footage supports that there were contributing factors to the incident when Ms Collett shifted out 1 horse width.
When reviewing the incident it was evident that MY DAKOTA rolled off the rail slightly at the same point where Ms Collett angled her mount out from behind that runner. We observed that SARONIC MISS over reacted to being crowded and this was not helped when SALT ‘N’ PEPPER was drifting back into the running line of that runner.
The aggravating fact was Ms Collett’s poor record although we acknowledge that she is one of the busiest riders in the country.
After taking into account all the above and placing emphasis on the contributing factors involved in this breach the Committee considers an appropriate suspension was 4 days.
