Information 6535 alleged a breach of Rule 530 (2) (b) by Apprentice Jockey R Allwood for riding GIMMEE D?CASH outside the guidelines over the use of his whip in the final straight.

The breach was admitted and, being an apprentice, Mr Allwood was represented by Jockey Sean Collins.

Stipendiary Steward A Coles demonstrated the incident on video drawing attention to the first 200 metres from the top of the straight where he identified Mr Allwood using the whip on his mount a total of fifteen or sixteen times without stopping as he was required to do under the guidelines.

Mr Allwood explained that he had been having some difficulty over the way he used the whip and had made some changes in his action. While he admitted the breach on this occasion he was still coming to terms with the changes and the horse he was riding had needed urging more than he expected.

Mr Collins suggested that the horse itself was very much part of the problem and this ought to be taken into consideration.

Mr Oatham stated it was accepted by the Stipendiary Stewards that Mr Allwood was a promising rider making good progress as he gained experience and had a good record generally. It was accepted that he had a problem over use of the whip and still had some work to do to deal with it. He had only once previously been charged with a breach of this rule on 3 December 2005 at Avondale although he had also received warnings. Nevertheless he was entitled to credit for his record and his efforts in dealing with his problems. It was, however, a breach for which a suspension was sought.

The committee accepts the recommendations regarding penalty and has taken into account what has been said. It confirms that a suspension is appropriate and it is imposed from the conclusion of racing on Sunday next 26 February 2006 until the conclusion of racing on Saturday 4 March 2006 involving three days of racing namely Wednesday at Te Rapa, Thursday at Awapuni and Saturday at Auckland.
