Accordingly, the Committee declared POSTD’OR to be a non – starter.
Facts:
Following the running of Race 5, Bayleys Real Estate 1400, an Information was filed pursuant to Rule 632. The Informant, Mr M Williamson, Requested a Ruling from the Judicial Committee to determine if the horse POSTD’OR was denied a fair start.
Rule 632 provides “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”
All parties present acknowledged that they understood the nature of the Information and the Rule.
Submissions for Decision:
Mr Williamson demonstrated to the Committee on the head - on video film that POSTD’OR's gate failed to open in conjunction with all the other starting stalls. He identified on the head - on film that POSTD’OR was very slow to begin. Mr Williamson submitted POSTD’OR was denied a fair start due to a mechanical failure of the starting stalls and was of the view the horse should be declared a non – starter.
Miss Smyth submitted her gate was very slow to open and this resulted in POSTD’OR jumping awkwardly. Miss Smyth added the horse had to force the gate open.
Mr Harrison submitted the gate was definitely slower than the others to open which denied POSTD’OR a fair start.
Reasons for Decision:
The Committee carefully considered the submissions presented and reviewed the video films. It was very clear POSTD’OR's starting stall was slow to open due to a mechanical failure. The Committee is satisfied this materially prejudiced the chances of POSTD’OR because he lost about 5 lengths at the start.
