Decision: -- Following race 4, an information was filed pursuant to Rule 858(4) when it was alleged that the defendant, A T Ireland, committed a breach of that rule when he omitted the pound pad while saddling SPIRIT OF SANFORD Following race 4, an information was filed pursuant to Rule 858(4) when it was alleged that the defendant, A T Ireland, committed a breach of that rule when he omitted the pound pad while saddling SPIRIT OF SANFORD. Mr Ireland admitted the offence. The information that Mr Ireland originally signed admitting the charge was filed under rule 869(2). This rule was found to be incorrect for the offence that had occurred. The error was discovered before formalities of the hearing commenced. Mr Ireland initialled the changes on information and acknowledged that his admission of guilt held for the changed rule. Mr Coles explained how when Mr Ireland was preparing SPIRIT OF SANFORD to be saddled the pound pad had fallen off the rail. A stable attendant had picked it up but had put it on a rail in the next tie-up stalls. Consequently Mr Ireland had omitted to see it and the horse had raced with the incorrect weight. Mr Coles said that Mr Ireland had been very cooperative and it was obviously an honest error. Mr Coles asked for a fine of $500. Mr Ireland confirmed that it was an unintentional error.
