Following race 2 an information was filed pursuant to Rule 871 (1) (d) when it was alleged by Stipendiary Steward Mr A Coles that Mr A Peard , rider of SUMMERSKI, permitted his mount to shift ground outwards near the 450 metres when not sufficiently clear.
Following race 2 an information was filed pursuant to Rule 871 (1) (d) when it was alleged by Stipendiary Steward Mr A Coles that Mr A Peard , rider of SUMMERSKI, permitted his mount nearing the 450 metres to shift ground outwards and into the line of FIORANO (A Calder )when not sufficiently clear.
--Mr Peard admitted the breach.
--Mr M Willamson demonstrated the video films and showed where, near the 450 metres mark, Mr Peard moved out when not the required distance clear of FIORANO resulting in that runner being checked.
--Mr Peard said it was a minor incident, and the horse Fiorano was in his blind spot when the interference took place.
--Penalty
--Mr Coles produced Mr Peard’s record which he stated showed 2 charges this year. The 6th of February 4 days and the 22nd of March 6 days. He said the Committee should take into account his guilty plea, and the offence was at the lower end of carelessness. Mr Coles asked for a 4 day suspension.
--Mr Peard outlined to the Committee his riding engagements for the upcoming week.
--Decision
--The Committee took into account all submissions and evidence as presented with the following being relevant.
--1. Mr Peard’s record.
--2. His guilty plea.
--3. Degree of carelessness which we concede was at the lower end.
--4. Mr Peard’s upcoming engagements.
--Accordingly we impose a suspension starting after racing on 17th May and concluding after racing on the 24th of May 2008 (4 Days)
