Decision:
--The information charged Defendant M Wenn, as the rider of Hauriri Girl in Race 2, with failing to weigh in after placing fifth. The Committee was also asked to address the issues of the disqualification of Hauriri Girl and the Defendant's riding fee in terms of the respective Rules.
--Presenting his case, the Informant detailed how it was noticed that the Defendant, upon finishing in fifth place in the race, was not among the riders who, as required, weighed in post race. When a check was made, the Defendant was located in the Jockey's room, but by this time had put her gear down.
--The Informant stated that the Defendant had not realized that she was required to weigh in, and had not heard the call of place getters. Whilst conceding that there were sometimes difficulties for riders hearing the call, he affirmed that it was still the rider's duty to check whether they were required to weigh in.
--The Informant further advised that the difference between fifth and sixth placing was $150.00, that he considered that the breach should be reflected by a monetary penalty, and that the fine be a like amount, $150.00.
--When asked to respond, the Defendant responded that she had not breached the weigh in Rule in 15 years of riding, and that it had been that it was an error of judgment on her part. She stated that when she returned to the birdcage enclosure she entered through the non placed horses gate, was not made aware that she was to weigh in, and that when she walked past the scales she saw six riders in that area and assumed she was not required.
--The Committee, after taking into account the Defendant's good record, assessed the appropriate penalty to be as recommended and imposed a fine of $150.00.
--In terms of Rule 856 (1) Hauriri Girl was disqualified from the race, and under Rule 523(3), the Committee determined that the disqualification circumstances did not warrant a direction that she retain her riding fee, which was duly forfeited.
