As Mr Hills admitted the breach I find the charge proved.

Penalty:

I grant Mr Hills' request to seek a deferment to his suspension as per Rule 1106(2).

Accordingly, I impose a suspension on Mr Hills which will commence after racing on 16 November and conclude after racing on 24 November (5 North Island days).

The penalty did not include any South Island meetings as Mr Hills confirmed that he did not intend riding at any upcoming South Island meetings.

Facts:

Following race 7, N – Compass 1400, an Information was filed pursuant to Rule 638(1) (d). The Informant, Mr Williamson, alleged that passing the 1300 metres Mr Hills allowed his mount SPEEDY JAX to shift in, dictating CRIMSON PRINCE (T Thornton) in onto UNDEFINED (L Innes) which was crowded and shifted into the line of ALL THE WAY (P Taylor) which was checked.

Mr Hills acknowledged that he understood the nature of the charge and the Rule.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Robinson identified shortly after the start Mr Hills allowed his mount to shift in when not the required distance clear. In doing so he dictated CRIMSON PRINCE in placing Mr Innes the rider of UNDEFINED in a tight position who in turn checked ALL THE WAY. He said in mitigation were the racing manners of CRIMSON PRINCE and UNDEFINED which were racing ungenerously at the point.

Mr Hills admitted the breach and declined to submit any evidence surrounding the incident.

Submissions for Penalty:

Mr Williamson produced Mr Hills' record which showed 2 previous breaches under this Rule in the last 12 months. He said there were some mitigating factors which I should consider and submitted a suspension at the low end would be appropriate.

Mr Hills advised that he had upcoming commitments at Tauranga on November 16, and that any period of suspension could commence after that. He confirmed that he rode all over the North Island.

Mr Hills made no submissions on penalty.

Reasons for Penalty:

I carefully considered all the evidence and submissions presented. I have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Mr Hills' admission of the breach and his good record in relation to this Rule. The aggravating factors are the level of carelessness is in the low to mid - range with 3 horses receiving varying degrees of interference when Mr Hills permitted his mount to shift in when only ¾ of a length clear. It was noticeable on the side on film that ALL THE WAY received quite a severe check.

I did factor into the penalty the racing manners of CRIMSON PRINCE and UNDEFINED.

After taking into account all the above factors I consider an appropriate penalty is a 5 day suspension.
