The Committee granted a deferment to Mr Harris suspension as per Rule 1106(2).
Accordingly, Mr Harris had his license to ride in races suspended for a period to commence after racing on 12 November and conclude after racing on 17 November 2017 (4 National riding days).
Facts:
Following the running of Race 4, AVONDALE SUNDAY MARKETS, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Coles, alleged that Mr Harris allowed his mount FOREVER BLUE to shift in when not sufficiently clear of NARVICK which was forced in onto ALL TRUMPED UP which was checked near the 900m.
Mr Harris acknowledged that he understood the Rule and confirmed his admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Jones used the available video footage to demonstrate the incident. He identified that Mr Harris allowed his mount to shift in near the 900m when no more than 1 length clear of NARVICK which was forced into the line of ALL TRUMPED UP which was checked.
Mr Harris stated that he allowed his mount to slide in a couple of strides too much and added that his mount was green.
Submissions for Penalty:
Mr Coles produced Mr Harris record which showed no previous breaches under this Rule in the last 12 months. He said the level of carelessness was in the low to mid-range, Mr Harris had misjudged the inward shift and was two strides too late in reacting. Mr Coles said that Mr Harris had a very good record.
Mr Harris advised that he had engagements up to and including the 12th of November and any proposed suspension could start after that date.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
When reviewing the incident the Committee observed that Mr Harris shifted in 1 horse width and in doing so crowded NARVICK which was forced in onto ALL TRUMPED UP which was checked losing approximately 1 length.
The Committee deemed the carelessness as low range.
The Penalty Guide for Judicial Committees effective 1 November 2017 recommends that the starting point for low range carelessness is 6 National riding days.
There were no aggravating factors.
The mitigating factors were Mr Harris’s admission of the breach and his excellent record. For these collective factors the Committee afforded Mr Harris a 2 day reduction.
